In spite of the fact that the seller is unaware that the check is a forgery, he still cashes it and gives the difference to the purchaser. If, throughout the course of the bank's investigation of the check, it is determined to be a fake, the seller will be held legally responsible for the loss. The dishonest con artist got away with his money, and the fault for this situation falls squarely on the shoulders of the honest merchant.
